Janzen Jackson, Nu'Keese Richardson, Michael Edwards Arrested on Charges of Armed Robbery
BREAKING NEWS from WVLT: Tennessee Volunteers freshmen Janzen Jackson and Nu'Keese Richardson were arrested around 2:00 AM this morning on charges of armed robbery. The incident in question occurred at the Pilot convenience store on Cumberland Avenue. Details are very scarce at the moment (a 'small semiautomatic handgun' was used and the incident occurred outside in the parking lot).
We'll add more as we know more. But remember: nothing good happens at this time of the morning. Given the outdoor location of the crime and the quick arrest, things don't look good at the moment. We'll see how Lane Kiffin deals with the first significant incident since his arrival in Knoxville.

"The victims stated that a black male then approached, wearing a black hoodie, brandished a black semi-auto handgun, opened the drivers door and stated, 'Give me everything you have.' The victims stated that a black male then exited from the passenger side of the Prius, wearing a black hoodie, walked around to the front passenger door of their car, opened it, and stated, 'Give us everything you've got.'
"The victims stated that they all presented their wallets to the suspects and showed them that they did not have money. The victims stated that a third black male then approached and told the other two black males, "We've got to go." The victims then stated that the three got into the Prius and that it was last seen traveling southbound on Volunteer Blvd West.
" ... The victims positively identified Edwards and Richardson as the two who approached their vehicle and demanded everything."

“At this time we are currently evaluating the circumstances surrounding an incident involving Mike Edwards, Janzen Jackson and Nu’Keese Richardson,” Hamilton said. “Any decisions or comments regarding their status will not be made until the evaluations are complete.”
[Note by Will, 11/12/09 4:16 PM EST] Jimmy Hyams of The Sports Animal reported at the top of today's Sports Talk brodcast that Janzen Jackson was inside the store when the events first took place. He also noted that the police found marijuana on two of the men when they were arrested, though it was not specified which two. Much of Jackson's fate now appears tied to his exact placement and role during the robbery attempt, and whether or not he was one of the men who had drugs on him. Jackson served a one game suspension for a failed drug test last week.
[Note by Will, 11/12/09 4:46 PM EST] WBIR of Knoxville is reporting that Janzen Jackson has been released on his own recognizance (down from a $15,000 bond), and according to Jackson's attorney Don Bosch, "vehemently asserts his innocence."

Hey,
Its a time honored tradition in the SEC that every SEC fan takes joy in the misery/arrests of other schools in the SEC. As an Alabama fan, we’ve took our lumps with Jimmy Johns and Elder over the past couple of years. Everybody gets a turn eventually, and today’s just yours.
The bright side, if there is one, is that the details of this seem so bad that Kiffin has it easy, there’s nothing to do but kick them off the team.

i’m an alabama fan on this website because i am looking for accurate information on what happened in relation to this incident.
joel and rocky top talk are widely known as the most reliable and reasonably objective folks for information on tennessee football. i expect nothing less on a situation of this magnitude where there is bound to be a lot of misinformation, speculation and a minimum of hard facts.

It is unfortunate, but it seems to me that when you make serious efforts to accumulate the best football talent in the country, you are going to get some bad apples on campus. I am disappointed that this happened, but it seemed like it was bound to at some point. Maybe not with those particular players (although something about Nu’Keese has always rubbed me the wrong way) but we knew Kiffin’s perfect police blotter record wouldn’t last forever.
Hopefully he sends a strong message to the rest of the team with how he deals with this and we can keep things under control.

Dismissed, to me, does seem a bit harsh. These are all freshmen, and freshmen do stupid things. Suspended for the rest of the season a complete minimum (or dismissed from the team, but allowed a spot to re-earn a spot on the team next year.)

From a bit more research, Aggravated Robbery — which this looks to be, if the police officers are convinced that the C02 gun looks like a deadly weapon, which they should — is a Class B Felony, which has the following punishment:
Class B felony: Not less than eight (8) nor more than thirty (30) years in prison. In addition, the jury may assess a fine not to exceed twenty-five thousand dollars ($25,000), unless otherwise provided by statute

Police were investigating an armed robbery Thursday morning on the University of Tennessee “Strip”
Reports from the scene indicate two black men approached the victim in the parking lot and used a small semi-automatic handgun to hold him up. They then fled south on Volunteer Boulevard in a powder blue-colored sedan. At least one of the suspects was described as wearing a black University of Tennessee T-shirt.
A KPD cruiser apparently spotted the car on Lake Loudoun Boulevard moments later and pulled it over on Neyland Drive at the KUB water treatment plant. At least three people inside the car were taken into custody and transported back to the Pilot to be identified by the victim.
A Volunteer TV News photographer on the scene captured the suspects while they were being identified. At least one of them wore a black University of Tennessee t-shirt with an orange Adidas logo and the phrase "impossible is nothing."

the one upshot of the particular weapon they allegedly used...
is they won’t face handgun related charges. those are often used to bolster a prosecutor’s leverage in getting a plea from a defendant. i’m certainly not familiar with the particulars of the law in tennessee but think of the kind of law that plaxico burress was convicted of.

From what I quickly read from the lawbook, the use of a non-deadly weapon in a manner that leads the victims to believe they are being harmed or threatened is what upgrades something from a simple robbery (a misdemeanor) to an aggravated robbery.
* Accomplished with a deadly weapon or by display of any article used or fashioned to lead the victim to reasonably believe it to be a deadly weapon;
So, this might actually complicate things, if my understanding is correct. If the victim’s weren’t afraid that they could be hurt, then the classification might get lowered. But, really, I’m no expert on what could happen, I can’t stress that enough.

but the point i’m making is that if a prosecutor has a weak case in terms of the armed robbery they often can fall back on the handgun charge to get a plea. if there was no handgun, it increases the importance of having an airtight case in terms of the robbery.
none of which has any bearing on what the athletic department might or might not choose to do, of course.

A C02 pellet-gun isn’t classified as “a deadly weapon” I don’t believe, so the aggrevated robbery charge would have to stand on the victims being led to believe that the weapon used was a deadly weapon. If they weren’t led to believe that it was a deadly weapon (even if it were the criminal’s intent) .. I’m not sure what from there. Every spot I look to seems to say that the victims feeling like they can come to harm from the weapon would raise the simple robbery charge to an aggrevated charge.

Janzen Jackson, 19, and Nukeese Richardson, 19, two freshman wide receivers at Tennessee, are charged with three counts each of attempted armed robbery. Two other suspects, Michael Edwards, 18, and Marie Montmarquet, 21, face similar charges.
Montmarquet is also being held on drug charges.

The victims told police the man opened the driver’s door and ordered the three to “Give me everything you have.” A second suspect then went to another door of the car and said, “Give us everything you’ve got.”
The four were taken back to Cumberland Avenue where the victims identified Edwards and Richardson as the two who demanded money.

There’s a per-year cap and a total cap. Off the top of my head, I can’t remember which is more prohibitive at the moment.
But if they do get kicked out, we might be able to use their schollies for more early enrollees.

Nuke was the inlet to the Pahokee pipeline, and Edwards was the point man for Glenville HS in Cleveland. Janzen was also big in getting back into LSU for the prime athletes. It’ll be interesting to see how this affects the work the staff has put in.

Honestly,
To set the tone for future recruits and to give these young men some hope, I’d rather see them suspended for the year and only dismissed if found guilty. At the same time, I want them gone. I don’t want Kiffin to be looked at as weak and/or compromising.

It sounds like there's the possibility that one wasn't actively involved.
Only two went to the car, and the third told them they had to leave. There is a possibility that one player happened to be present in a scene that went south and may deserve a little leeway.

In incidents like this, the charges can sometime be fluid as the police and the prosecutor work their way through the details. I’m not saying they will change, but that they can.
It’s easier to get the charges out there first and remove them later because they can process the names through the courts at once.

Billy Ray Thomas of Lower Helton Road, who was charged with attempted aggravated robbery and unlawful carrying of a weapon with the intent to go armed, received a three year sentence as a range one offender to serve 108 days. He was given credit for time served from December 27th, 2008 to April 13th, 2009 and has been released.
Under terms of the plea agreement, Thomas must undergo an alcohol and drug assessment and complete a Teen Challenge program for addiction or some similar treatment program. Thomas must also make a $75 payment to the economic crime fund.

Haha, seriously though, you guys do an awesome job with this blog, and your discussions are generally intelligent and reasonable for a bunch of passionate fans, so I respect you guys and enjoy reading what you guys are saying over here from time to time.
Just my two cents, if it turns out to be what it sounds like it is, its probably best to learn from Corch Meyer’s mistakes and send these kids packing. Handle the first situation like this tough and it’ll send the right message to kids coming into your program, fans, the media, etc. that you are better than that at Tennessee.
But lets play what if for fun: If Nu’keese had gone to Florida, lets see, simple battery is about a 6 months sentence or so, armed robbery about 4 years. So if Spikes gets a half game, Nu’keese gets 4 games? :-).

Is that he told the people they had to leave before the Cops were called (as in, before he knew that they would get caught.). He was described as arriving after the demand for money, so he (and the woman, for that matter) might not get charged with robbery, depending on how testimonies play out. Though I’ve no idea the legal process for determining this.

Looking away from the actual aggravated robbery and into what the woman and what Janzen Jackson could be facing, I found this web page. Now then, first and foremost, I don’t know if Jackson can get hit with the robbery charge. He wasn’t at the most immediate scene of the crime (he was described as coming up after the demands for money were met) and did not make any comments to the victims to indicate that he was, in any way, hostile towards them.
So, if he doesn’t get hit with the robbery charge, can he be hit with something else, or be considered an accomplice? From the page:
To prove that a defendant is an accomplice, the government must prove that he or she intentionally aided in the commission of a crime. This means that the defendant must realize that the principal is going to commit a crime and that the accomplice intends to help the crime succeed.
To distinguish the criminal culpability of one from another, the common law developed specialized terms for the various ways in which one could be an accomplice. For instance, a “principal in the first degree” was the person who actually carried out a crime. A “principal in the second degree” (an “aider and abettor”) was a helper who was present at a crime scene but in a passive role, such as acting as a “lookout.” An “accessory before the fact” was a helper who was not present at the crime scene. While some state laws retain the common law terminology, few states make any distinction between the criminal liability of crime perpetrators and their accomplices. All can be punished equally, whether they actually perpetrate a crime or only help bring it about.
So, with that in mind, one has to prove the questions: Did Janzen Jackson know that Nuke and Mike were going to commit a crime? It’s not definite; the two could very easily have had the pellet gun concealed in their hoodies and pulled them out when the car stopped. Yes, this is wishful/hopeful thinking on my part, but I’ve been in a situation like that, though in this case my friends decided to randomly light up a bong in a dorm room (I didn’t even know they smoked pot!) and I got caught for being there. Though, the cops weren’t called on us (thank god!).
The second question is did he help? Early evidence points at “no.” He didn’t provide the car, and unless he provided the gun or the hoodies, the second of which is highly unlikely, I can’t see how he could be called a helper in this. The testimony that he approached the situation and told the two to stop will likely go a long way in helping clear his name.
Despite that, all three of these players should be suspended indefinitely from the team, which I imagine that they will be. Those players who are found guilty should be dismissed from the team, and those that are found innocent should be allowed to be re-instated, with the missed games the punishment for their stupidity.

I think the most likely immediate response from Kiffin is an indefinite suspension of all players involved. If the facts being reported so far prove (to Kiffin) to be true, Nu’Keese and Edwards should eventually be dismissed from the team. Jackson is a tougher question, but perhaps he could be suspended for the remainder of this season and given a second (and final) chance to straighten up and fly right.

To Clear something up
One of the sources I was looking at was, in a word, retarded. A Robbery itself is a Class-C Felony, which is punishable by 3-15 years in prison. An aggrevated Robbery is a Class-B Felony, which is punishable from 8-30 years.
Based off of the mitigating factors I would think the sentencing would be near the bottom of that range, probably the minimum charge, really. I’ll go into why, from what I can tell from reading the lawbook (which I’m actually doing now) I think the sentencing would be lesser.

So he was just walking the streets at 2 am and happened upon his two teammates
and a pot smoking mexican girl. Then being the good Samaritan he told them yeah we should leave after his teammates tried to rob some people in an Hyundai. He was already suspended for smoking dope. He is gone too.

Im unfamiliar with the drug laws in tennessee anymore, but I would expect that if they found marijuana on a group of robbers they would probably check them all to bolster their case.
But then again, I also believe they have the right to refuse such a test, which they may have done if they had adequate representation with them upon arrest.

I would think undoubtedly.
I’m not 100%, but I thought that drug tests were SOP on arrests. And if the city doesn’t do it, the university probably has a mandatory policy on it.
(Not that it applies here, but it was that way with our people when I was in the Navy. Detainment by civil authorities = pee in the cup. And we’d even send our own guy over to pick them up and drive them back to base.)

Just throwing that out there, I don’t know how that may or may not affect that situation.
But it takes about 2 weeks for a urine test to come clean after marijuana use. Though if he recently used, there may be a spike in the test and higher levels than the previous test which would indicate post-positive use.

do we know when he actually took the test he failed? urine tests also can still nab you up to a month for weed depending on usage amount/frequency, and body fat/metabolism. a high class athlete should be on the short side of things, though if he was a ricky williams type before he got caught it could be more.

Constant water intake will also dilute the sample
which an athlete will be drinking much of. A hair sample will last 3+ months (6 if its from the nape), but if the police dept administered it, it could have very well been a blood test too, which would probably the most accurate of all three. I don’t know what results of these look like, but most just list potential narcotics and the parts-per-million of that found in their system.

Whats happened has happened....now two things can come of this..
1. Kiffen kicks all 3 off team and sets the precedent and foundation for a solid program.
2. Kiffen lets Jackson stay on the team because he finds a loophole legally and sets the precedent for the type of program he wants in future Talent Potential> Character Issues….remember Jackson was just suspended LAST WEEK for failing a drug test.

Let's not talk about spin, let's talk about what happened
1. Jackson was with the guys, goes into the convenience store to give an appearance of legitimacy while Nuke and Mike rob folks. Jackson is off the team. This scenario seems unlikely.
2. Jackson was with the guys, goes into the convenience store, sees his friends brandishing a gun and says “guys, we need to leave” to keep them from doing anything more stupid than they already have (i.e. shoot someone). Tough call, but IMO, Jackson stays on the team with a suspension.
3. Jackson walks out of a convenience store, sees his friends getting confrontational, doesn’t see the gun, tells them “we need to leave” to prevent anything bad from starting up. Jackson stays on the team with no suspension. This also seems unlikely, although probably more likely than #1.

4. Jackson fails a drug test the week prior and is punished by suspending him for the game to try to teach him a lesson.
Jackson is not caught one week later at 2AM with some friends caught up in a felony and has more weed issues as it is found in the vehicle. There does come a point when you just look at the facts and say ok he got his chance last week and he blew it. I do feel though as the charges start to actually unfold that he will be cleared of his involvement in the felony robbery. My take is that it actually will help your program in the long run if you set the precedent for this type of action. So in the future if a recruit is caught using drugs he is given ONE opportunity to get his stuff together. If you allow him back you are essentially telling your guys that you work on a 3 strike policy so go ahead and make sure you use your 2 freebies.

News-Sentinel continues to update their story, now with quotes from the victims
In an interview this afternoon, Zickefoose and Smith told the News Sentinel they had no inkling beforehand that the people in the parking lot were about to attempt a robbery. Even during the incident, Zickefoose, who was driving, said the man with the weapon wasn’t overly aggressive.
“I could just tell he wasn’t going to shoot me. He didn’t have too much authority,” Zickefoose said.
The victims said they showed the two men their empty wallets and said they had no money.
“I said, ‘Sorry, we don’t have anything to give you.’ " Zickefoose said.
“We ain’t got nothing but a cheeseburger,” Smith added, “but they didn’t take that.”
A third man then approached the car and told the other two men in hoodies, “We’ve got to go,” DeBusk said.
The three men got into a 2010 Toyota Prius driven by a woman and fled the area. Zickefoose said he glanced at the Prius during the attempted heist and noted the woman seemed amused.
“She was smiling, with a big grin on her face,” Zickefoose said (same link as in post)

Can it get any worse?! WBIR is reporting that they found that Prius back at Gibbs Hall. They tried to rob somebody at (pellet)gunpoint and then drove back to the dorms in their Prius like good little boys and girls?! Man.
This is sounding dumber and dumber the more it goes on.

One of the victims was interviewed by WATE:
Corey B. Zickefoose, 20, said he was sitting in the driver’s seat of a 1998 Hyundai Elantra on Cumberland Ave. when one of the players pulled a gun and demanded money.
But that’s not enough to prevent the players from being kicked off the team, he told 6 News.
“I think they should still be able to play football, regardless,” he said. “Tennessee is my place. It’s my football team.”

KPD dispatched the SWAT team and helicopter to find the threat to our national security
