Holding his mother’s hand, Cleveland Browns wide receiver Donte’ Stallworth walked out of Miami-Dade County jail about noon Thursday after posting bond on a charge of DUI manslaughter.

‘’I just want to extend my condolences to the Reyes family. My prayers are with them,’’ Stallworth told a group of reporters and cameras waiting outside the jail. ``I have full confidence and faith in the legal process.’’

Holding this mother’s hand, for God’s sakes. Stallworth really shows all evidence of a man who is truly sorry and can really bat back his pride. Really sad story for the Reyes and Stallworth families.

One thing I would ask

And I may sound stupid, but I gotta know. Was Reyes crossing the street without using a crosswalk? Like jaywalking? I mean that doesn’t matter, really. He’s still dead and it’s Donte’s fault. I’m just asking for my own clarification.

From what I read, he was not on a crosswalk.

I can’t remember the source (GVX, I think but uncertain).

So that does mean he was technically jaywalking-ish or no? Like I said I’m only asking for my clarification.

My memory's the same as hooper's

Which would mean they’re talking about some sort of comparative fault in the civil context. Likely, more would be attributed to Stallworth than to the pedestrian.

It’s a shame all around.

He was not in a crosswalk

so technically, yes, he was jaywalking. But we do not really know all of the details, what we do know is:

It was sometime around 6:00 AM
Donte was driving home with a BAC of .126
He hit Mr. Reyes, stopped and called the police
Donte was driving about 10+ mph over the speed limit

What cannot be confirmed at the moment:
Donte has also said that he saw Mr. Reyes and attempted to warn him by flashing his lights to get out of the way.

Questions that I have:
How/where exactly did Donte hit him? Was it near the sidewalk or was he in the middle of the street (i.e: did Stallworth swerve/lose control and hit Reyes, or did Donte come across him in the middle of the road and unable to react in time?) Why didn’t Donte slow down/stop/move into another lane?

I dont know if my questions really make any difference, but it would help paint a better picture for us. Its an all around unfortunate and sad situation.

good points

All of that will matter in the inevitable civil suit when the jury/judge is asked to apportion fault. Not quite sure how it plays out in the criminal charges. Best guess is that it won’t affect the DUI but may in fact mitigate or get rid of the manslaughter charge all together.
